Any order for a Product offered on the Site entails the User’s full and unreserved acceptance of these General Terms and Conditions of Sale.During the ordering process, once you have selected your payment method, you must proceed to pay for your order; this payment firmly and definitively concludes the contract of sale between you and SERGE PARIENTE.

We shall not be liable to you or to any third party for any price change or for any modification, suspension or discontinuance of the Service.

SERGE PARIENTE reserves the right to change the prices of the Items at any time; Items are invoiced on the basis of the prices in force when each Order is confirmed.
The price of the Items invoiced is therefore the price shown at the time of the Order.
THE ITEMS REMAIN THE SOLE PROPERTY OF SERGE PARIENTE UNTIL FULL PAYMENT OF THE PRICE, WHICH THE CUSTOMER ACKNOWLEDGES AND ACCEPTS.
SECTION 5 – PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only in accordance with our Return Policy.
We will fulfil your order subject to the availability of our stock.
Should any of the Products ordered be out of stock, we undertake to contact you by email within a maximum of 15 days from the date of your order to inform you and to let you know when, if at all, the product could be delivered to you. You may then either maintain or cancel your order.
If you maintain your order and receive a partial delivery, you will only be charged for the price of the products delivered, as and when they become available.
We have made every effort to display as accurately as possible the colours and images of the products that appear in the store. We cannot, however, guarantee that your computer monitor’s display of any colour will be accurate.

Only the Products shown on the Site on the day the Customer places the order are offered for sale.
Product offers and prices are valid while stocks last and for as long as they are displayed on the site.
The photographs reproduced to illustrate the Products are not contractually binding.
SECTION 6a – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email address and/or billing address or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiry dates, so that we can complete your transactions and contact you as needed.

SECTION 6b – PAYMENT FOR THE ORDER
The price invoiced to the Customer is the price stated in the Order confirmation sent to the Customer by email.
The Order is payable immediately, by bank card (CB, Visa, MasterCard) or payment account (PayPal).
Once the Order has been shipped, the Customer is informed by email that their invoice, including delivery charges and the applicable VAT, is available online in their customer account.
Transactions on the Site are handled by a secure online payment platform.
They are protected by a solution providing highly secure pages for entering payment details: card number, expiry date and security code.
This platform encrypts this payment data and then transmits it to the bank in complete confidentiality, making it inaccessible to third parties.
SECTION 6c – DELIVERY METHODS
The Customer will receive an Order number by email confirming that the Order has been duly registered. The Customer will be kept informed of the various stages of the Order by email.
Shipments are notified to the Customer by email, at the email address entered in their customer account.
The Items ordered will be delivered within a maximum of thirty (30) calendar days from registration of the Order, subject to full payment of the price.
Several delivery methods are offered to the Customer; the chosen method and its price are shown before the Order is confirmed.
- For shipments within mainland France: parcels are delivered by CHRONOPOST, either to a pick-up point (Chrono Relais) or by express home delivery (Chrono 13).
- For shipments within the European Union: parcels are delivered by DHL, either to a pick-up point (DHL Service Point) or to the Customer’s home, or by a partner carrier for certain destinations.
- For shipments outside the European Union: parcels are delivered by CHRONOPOST.
Orders are handed over to the carrier within twenty-four (24) working hours. In mainland France, express home delivery (Chrono 13) takes place on the working day following dispatch.
Orders placed on a Saturday, Sunday or public holiday will only be confirmed and processed from the next working day.
Using the tracking number, the Customer can follow the progress of their parcel on the website of the carrier they selected.
The Customer is responsible for providing accurately all the details required for the proper routing and delivery of their Order (for example, door codes or access instructions).
If the Customer is absent at the time of delivery, a delivery notice will inform the Customer of how the parcel is being held and made available for collection, under the full and sole responsibility of the carrier.
If the delivery address provided by the Customer is invalid and the parcel is consequently returned as undeliverable to the address given, the cost of re-shipping the parcel to the new address provided shall be borne by the Customer.
A delivery note is included in the parcel, listing the items ordered and actually delivered.
The Customer bears full and sole responsibility for all risks relating to the Items from the time of delivery.
SECTION 6d – DELIVERY TIMES
Items are delivered to the delivery address given by the Customer when placing the Order, no later than the date indicated at the time of the Order, depending on the country of delivery.
SERGE PARIENTE makes every effort to deliver the Order within 3 working days of the Order and undertakes to deliver within a maximum of 30 calendar days.
If delivery is delayed by more than 7 working days beyond the above-mentioned maximum period, the Customer may contact SERGE PARIENTE by email to request that delivery be made within a reasonable additional period. If this new deadline is not met, the Customer may ask SERGE PARIENTE by email to cancel the Order.
The contract, and therefore the sale, shall be deemed terminated upon receipt by SERGE PARIENTE of the email or letter in which the Customer notifies it of this decision, unless delivery has taken place between the sending and the receipt of the Customer’s email or letter.
Should the Order be definitively cancelled, the Customer will be refunded the price paid for the Order within 14 calendar days of the cancellation being confirmed by email.
Should the Customer receive the parcel after the Order has been cancelled, SERGE PARIENTE will refund the Items and the return costs upon receipt of all the Items in their perfect original condition.
Each delivery is deemed to have been made as soon as the parcel is made available to the Customer, in particular by the carrier, as recorded by the tracking system used by the carrier.
If the parcel is damaged or the Item does not match the Customer’s Order, the Customer must initiate the return procedure described in the following article within 30 calendar days of shipment.
Where delivery is made by a carrier requiring an appointment with the Customer, the carrier will contact the Customer as soon as possible to arrange a delivery appointment, no later than 30 calendar days from the date the Order was confirmed.
SERGE PARIENTE cannot be held responsible for any delay in delivery due solely to the Customer’s unavailability after the carrier has proposed several appointments.
If, within the same Order, the delivery dates of several Items differ, the delivery date is based on the date furthest from the order date.SECTION 6e – EXCHANGES AND RETURNS
The Customer has fifteen (15) calendar days from receipt of the Order to request an exchange or a return, by contacting customer service at service-client@sergepariente.com. Where this period ends on a Saturday, Sunday or public holiday, it is extended to the next working day.
The Customer prints and completes the exchange and return form below and encloses it in the parcel. The Customer may also bring the Items back free of charge to the showroom, 9 rue Béranger, 75003 Paris.
Download the exchange and return form (PDF)
Exchange. From mainland France and the European Union, return shipping is complimentary for an exchange, limited to one exchange per Order and subject to availability: SERGE PARIENTE checks that the requested piece is available, sends the Customer a prepaid return label, then ships the new piece free of charge. If the requested piece is not available, the Customer may choose another Item or request a refund; the conditions for returns for a refund then apply.
Return for a refund. Return shipping costs are borne by the Customer, in accordance with Article L221-23 of the French Consumer Code (Code de la consommation). If the Customer received a prepaid return label and finally opts for a refund, a flat return fee of ten (10) euros from mainland France, or fifteen (15) euros from the European Union, is deducted from the amount refunded. The Customer sends the parcel with the carrier of their choice, preferably with tracking, to the following address:
La Maison SERGE PARIENTE – Returns Department
9 rue Béranger
75003 Paris – France
+33 1 48 87 69 11Refund of a piece received in exchange. A piece received in exchange may be returned for a refund within fifteen (15) days of receipt. The flat fee for the first return (€10 from mainland France, €15 from the European Union) is then deducted from the amount refunded, return shipping of the exchanged piece is borne by the Customer, and shipping costs for the exchange piece are not refunded.
Outside the European Union. Return shipping costs are borne by the Customer, for an exchange as well as for a refund. The Customer marks the parcel as an “online return”; otherwise the parcel may be refused and sent back at the Customer’s expense.
Defective or non-conforming Item. If an Item delivered is defective, damaged in transit or does not match the Order, return costs are borne by SERGE PARIENTE.
Condition of Items. Items must be returned new, unworn, unwashed, complete, with their original tags and in their original packaging. A return that does not meet these conditions or the above time limit may be refused. The Customer may be held liable for any depreciation of the Items resulting from handling beyond what is necessary to establish their nature, characteristics and proper functioning.
Refund. Once the Items have been received and inspected, SERGE PARIENTE refunds the price of the returned Items together with the corresponding original delivery costs, up to the standard delivery rate, no later than fourteen (14) days after receipt of the return, to the payment method used for the Order. Additional costs arising from the choice of express delivery and return costs borne by the Customer are not refunded.
SECTION 6f – RIGHT OF WITHDRAWAL
In accordance with Articles L221-18 et seq. of the French Consumer Code, which transpose Directive 2011/83/EU, the Customer has a statutory period of fourteen (14) days from receipt of the Items to exercise the right of withdrawal, without giving any reason or paying any penalty. La Maison SERGE PARIENTE extends this period to fifteen (15) days.
The Customer exercises this right by informing SERGE PARIENTE of their decision by email at service-client@sergepariente.com or by means of the exchange and return form, then sends the Items back no later than fourteen (14) days after communicating that decision, as set out in section 6e. Return costs are borne by the Customer, except for an exchange from mainland France or the European Union, or for a defective or non-conforming Item.
SERGE PARIENTE refunds the Customer under the conditions set out in section 6e, no later than fourteen (14) days after receipt of the returned Items.
SECTION 6g – STATUTORY WARRANTIES
Independently of exchanges and returns, all Items benefit from the statutory guarantee of conformity and the guarantee against hidden defects, provided they have been used normally and the care instructions have been followed.
Statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): the seller is liable for any lack of conformity existing at the time of delivery and appearing within two (2) years of delivery. The Customer may obtain repair or replacement of the item or, failing that, a price reduction or cancellation of the sale.
Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the seller is liable for hidden defects in the item sold that make it unfit for its intended use. Any claim must be brought within two (2) years of discovering the defect.

You acknowledge and agree that we provide access to such tools “as is” and “as available”, without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

ARTICLE 9 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example, contest entries) or, without a request from us, you send creative ideas, suggestions, proposals, plans or other materials, whether online, by email, by post or otherwise (collectively, “comments”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Use are effective unless and until terminated by either you or us. You may terminate these Terms of Use at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If, in our sole judgement, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Use, we may also terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and/or we may accordingly deny you access to our Services (or any part thereof).
ARTICLE 17 – ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
These Terms of Use and any policies or operating rules posted by us on this site or in respect of the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including but not limited to any prior versions of the Terms of Use).
Any ambiguities in the interpretation of these Terms of Use shall not be construed against the drafting party.Force majeure:
SERGE PARIENTE shall not be liable for the total or partial non-performance of its obligations under this contract where such non-performance is caused by an event of force majeure, including in particular any disruption or total or partial strike affecting, among others, postal services and means of transport and/or communication, flood or fire.
SERGE PARIENTE will notify the User of any event of force majeure within 5 working days of its occurrence.
The Parties agree to consult each other as soon as possible in order to determine how the order will be handled for the duration of the force majeure event.

SERGE PARIENTE shall in no event be held liable for any infringement by a user of rights held by third parties committed in the course of that user’s activities on the Site.
Failing an amicable settlement between the Customer and SERGE PARIENTE, any dispute shall fall within the exclusive jurisdiction of the French courts of the Customer’s place of residence.
These General Terms and Conditions of Sale in no way affect the Customer’s statutory rights as a consumer. For further information on these rights, the Customer should contact their local authority or a consumer advice organisation.

This service is provided by PayPal, subject to its approval and its own terms of use, and is reserved for adult residents of France.
